Nothing in these Terms affects your statutory rights under applicable consumer protection laws, including the EU Consumer Rights Directive (2011/83/EU), the UK Consumer Rights Act 2015, the Australian Consumer Law, or equivalent legislation in your jurisdiction.
These Terms of Service ("Terms") govern your access to and use of the Tesshin website, online store, and related services (collectively, the "Services"). The terms "we", "us", and "our" refer to Tesshin.
By accessing the Services or placing an order, you confirm that you have read, understood, and agreed to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, all of which are incorporated by reference. If you do not agree to these Terms, you must not use the Services.
1. Eligibility & Account
1.1 Age requirement
By using the Services, you confirm that you are at least 18 years of age and have full legal capacity to enter into a binding agreement under the laws of your jurisdiction. If you are under 18, you may only use the Services under the direct supervision of a parent or legal guardian who agrees to these Terms on your behalf.
Tesshin does not knowingly collect personal data from children under 13 (or under 16 where required by applicable law, including EU GDPR Article 8). If we become aware that a child under the applicable minimum age has provided personal data without verifiable parental consent, we will delete that data promptly.
1.2 Account registration
Where account registration is required, you agree to provide accurate, complete, and current information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. You may not share, transfer, sell, or assign your account to any third party without our prior written consent. Tesshin reserves the right to suspend or terminate accounts that violate these Terms.
2. Products & Representations
Tesshin makes reasonable efforts to display product descriptions, colours, dimensions, and features accurately. On-screen colours and appearances may vary depending on your device and display settings; minor variations do not constitute a defect.
All product information, pricing, and availability are subject to change without notice. Tesshin reserves the right to limit quantities, discontinue products, or restrict sales to any person, region, or jurisdiction at our discretion.
Products are intended for personal, non-commercial use only. You may not purchase Tesshin products for commercial resale or redistribution. We reserve the right to decline orders we reasonably believe are intended for resale.
3. Assumption of Risk & Athletic Use
Please read this section carefully. It sets out important limitations on Tesshin's liability for injuries sustained during athletic use of our products.
3.1 Nature of combat sports
Brazilian jiu-jitsu and grappling sports are full-contact combat sports involving submission holds, joint locks, chokes, throws, takedowns, and sustained physical contact. These activities carry inherent and significant risks of physical injury, including but not limited to bruising, abrasions, muscle strains, joint injuries, dislocations, fractures, and in rare cases, more severe harm. These risks exist regardless of the equipment worn.
By purchasing and using Tesshin products, you expressly acknowledge that you understand and voluntarily assume all risks associated with participation in combat sports and physical training.
3.2 Products are not protective equipment
Tesshin rashguards, shorts, and all other gear are performance athletic apparel designed for comfort, durability, and freedom of movement. They are not personal protective equipment (PPE), are not certified to any safety or protective standard, and are not designed or intended to prevent or reduce physical injury of any kind.
Tesshin makes no representation, warranty, or guarantee that its products will protect you from injury during training, competition, or any other physical activity.
3.3 Customer assumption of risk
To the maximum extent permitted by applicable law, by purchasing and using Tesshin products you:
- Acknowledge that participation in combat sports carries inherent risks that cannot be eliminated regardless of the apparel or equipment used
- Confirm that you are physically fit and medically able to participate in combat sports, and that you have obtained appropriate medical clearance where relevant
- Accept full and sole responsibility for your safety and wellbeing during all physical activities in which Tesshin products are worn or used
- Release and discharge Tesshin from all claims, demands, losses, and liabilities arising from physical injury sustained during training, competition, or athletic use of our products, to the fullest extent permitted by applicable law
3.4 Proper use and maintenance
Tesshin products must be used for their intended athletic purpose and maintained in accordance with the care instructions on garment labels and on our website. Tesshin is not responsible for any injury, damage, or failure arising from:
- Use of gear that does not properly fit the wearer
- Continued use of gear that is visibly worn, damaged, or degraded
- Failure to follow garment care instructions (including incorrect washing or drying)
- Modification or alteration of the product in any way
- Use in a manner inconsistent with the product's intended purpose
- Exposure to chemicals, bleaching agents, or substances not indicated as compatible with the product
3.5 Minors
Parents and legal guardians who permit minors in their care to use Tesshin products accept these Terms and assume all associated risks on the minor's behalf. Tesshin strongly recommends that minors participate in combat sports only under qualified adult supervision in age-appropriate programmes.
3.6 Mandatory exception
Nothing in this Section 3 limits or excludes Tesshin's liability to you where:
- A proven manufacturing defect in our product was the direct and proximate cause of your injury
- Liability arises under applicable mandatory product liability legislation, including the EU Product Liability Directive (85/374/EEC), the UK Consumer Protection Act 1987, or the Australian Consumer Law
- Liability arises from Tesshin's own gross negligence or fraudulent conduct
- Applicable law in your jurisdiction does not permit such limitation or exclusion
4. Orders & Contract Formation
4.1 Offer and acceptance
Placing an order constitutes your offer to purchase. A binding contract is formed only when Tesshin sends a written order confirmation by email. Tesshin reserves the right to decline any order for any reason, including pricing errors, stock issues, suspected fraud, or inability to deliver to your location.
4.2 Modifications & cancellations
Orders cannot be guaranteed for modification or cancellation once placed. Please refer to our Return & Refund Policy for details of any applicable pre-dispatch cancellation window and the EU/UK right of withdrawal.
5. Pricing, Currency & Payment
5.1 Pricing and currency
Prices are displayed in the currency applicable to your region as indicated at checkout. Prices are subject to change without notice. The price confirmed at checkout is binding.
5.2 Price errors
In the event of a clear and obvious pricing error, Tesshin reserves the right to cancel affected orders and issue a full refund. We will notify you promptly if this occurs.
5.3 Taxes and additional charges
Displayed prices exclude applicable customs duties, import taxes, VAT, and GST unless expressly stated otherwise at checkout. Customers are responsible for all applicable import charges at their destination. Refer to our Shipping Policy for region-specific customs guidance.
5.4 Payment authorisation
By placing an order, you authorise Tesshin to charge your selected payment method for the total confirmed order amount. You warrant that you are authorised to use the payment method provided. Payment is processed by authorised third-party payment service providers; Tesshin does not store payment card data.
6. Shipping, Delivery & Risk
Shipping is governed by our Shipping Policy, which forms part of these Terms.
Risk of loss and damage to goods passes to you upon delivery of the goods to the address provided in your order. For EU and UK customers, and in accordance with Article 20 of the EU Consumer Rights Directive, risk remains with Tesshin until you — or a person you have designated to receive the goods — take physical possession of them. This provision takes precedence for EU and UK consumers.
7. Intellectual Property
All content on the Services — including trademarks, logos, product names, slogans, images, graphics, text, video, and the selection and arrangement of these elements — is owned by or licensed to Tesshin and protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You may not reproduce, copy, distribute, modify, publicly display, or create derivative works from any Services content without Tesshin's prior written consent. All rights not expressly granted are reserved. Unauthorised use of Tesshin's trademarks or brand assets may constitute infringement under applicable law.
8. User Conduct & Prohibited Uses
You may only use the Services for lawful purposes consistent with these Terms. You must not:
- Violate any applicable local, national, or international law or regulation
- Infringe any intellectual property rights of Tesshin or any third party
- Engage in harassment, defamation, abuse, or harmful or threatening conduct
- Submit false, misleading, or fraudulent information or product reviews
- Transmit viruses, malware, or any harmful or disruptive code
- Engage in phishing, spamming, or unsolicited commercial messaging
- Impersonate any person or entity
- Scrape, data-mine, or systematically extract data from the Services
- Interfere with or compromise the security or integrity of the Services
Violations may result in immediate suspension or termination of access and, where applicable, referral to relevant authorities.
9. User-Generated Content & Reviews
Where you submit reviews, photographs, ratings, or other content to the Services, you grant Tesshin a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, adapt, publish, translate, and distribute that content in any media for any lawful purpose.
You represent that submitted content is your original work, does not infringe third-party rights, and does not contain unlawful, defamatory, or offensive material. Tesshin reserves the right to remove any submitted content at our discretion without notice.
10. Feedback & Ideas
Unsolicited feedback, suggestions, or ideas you communicate to Tesshin are provided on a non-confidential basis. You grant Tesshin a perpetual, worldwide, royalty-free, irrevocable licence to use such submissions for any purpose without compensation or attribution. Tesshin is under no obligation to respond to or implement any feedback.
11. Third-Party Tools & Links
The Services may include access to third-party tools, integrations, or links to external websites provided for convenience only. Tesshin does not endorse, control, or assume responsibility for the content, accuracy, policies, or availability of any third-party service. Your use of third-party tools or websites is at your own risk and subject to their respective terms.
12. Platform Provider
The Tesshin website and online store are operated using the Shopify platform. Shopify provides technical infrastructure to Tesshin and is not a party to any transaction or contract between you and Tesshin. Shopify has no obligations or liabilities to you in connection with your purchase or use of Tesshin products.
13. Privacy & Data Protection
Your personal data is collected, processed, and stored in accordance with our Privacy Policy, which forms part of these Terms and should be read alongside them.
Tesshin is committed to compliance with applicable data protection legislation, including the EU General Data Protection Regulation (GDPR), the UK GDPR and Data Protection Act 2018, the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486), and, where applicable, the California Consumer Privacy Act (CCPA). Your rights to access, rectify, erase, or restrict processing of your personal data are described in our Privacy Policy.
14. Errors, Inaccuracies & Product Availability
Tesshin reserves the right to correct errors, inaccuracies, or omissions in product information, pricing, availability, or promotions at any time, including after an order has been placed. Where a material error necessitates order cancellation, a full refund will be issued promptly. This does not limit your statutory rights.
15. Disclaimer of Warranties
15.1 Services (website and digital features)
The Tesshin website, digital content, and other non-product features of the Services are provided "as is" and "as available" without warranties of any kind. Tesshin does not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components. You use the Services at your own risk.
15.2 Physical products
This disclaimer does not apply to Tesshin's physical products. Your rights in respect of physical goods are governed by our Return & Refund Policy and, where applicable, by mandatory consumer protection laws in your jurisdiction — including statutory guarantees of acceptable quality, fitness for purpose, and conformity with contract description. These statutory guarantees cannot be disclaimed and are not affected by this section.
16. Limitation of Liability
16.1 Exclusion of consequential loss
To the fullest extent permitted by applicable law, Tesshin and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages — including loss of profits, revenue, data, goodwill, or business opportunity — arising from your use of the Services or purchase of products, even if advised of the possibility of such damages.
16.2 Aggregate cap
Where liability cannot be fully excluded, Tesshin's total aggregate liability to you for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim.
17. Indemnification
Subject to applicable law, you agree to defend and hold harmless Tesshin and its officers, employees, and agents from any third-party claims, losses, and expenses (including reasonable legal fees) arising directly from your wilful breach of these Terms, your violation of applicable law, or the infringement of a third party's intellectual property rights through content you submit to the Services.
This obligation does not apply to claims arising from Tesshin's own negligence or breach of duty. To the extent that applicable consumer protection law in your jurisdiction limits or prohibits indemnification obligations in consumer contracts, this section is disapplied or read down accordingly.
18. Force Majeure
Tesshin shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, government actions, trade sanctions, carrier disruptions, cyberattacks, or industrial action. In such events, Tesshin will take reasonable steps to notify affected customers and fulfil outstanding orders as soon as practicable.
19. Termination & Suspension
Tesshin may suspend or terminate your access to the Services at any time with or without notice, including for breach of these Terms. Termination does not affect rights and obligations accrued prior to termination. Sections 3, 7, 10, 15, 16, 17, 18, 22, and 23 survive termination.
20. Consumer Rights & Statutory Protections
Nothing in these Terms excludes, restricts, or modifies any statutory right or consumer guarantee available to you under applicable law.
European Union: EU consumers have rights under the Consumer Rights Directive (2011/83/EU). Any term found to be unfair under the Unfair Terms in Consumer Contracts Directive (93/13/EEC) is without effect as against EU consumers.
United Kingdom: UK consumers retain all rights under the Consumer Rights Act 2015, Consumer Contracts Regulations 2013, and Unfair Contract Terms Act 1977.
Australia: Australian consumers have statutory guarantees under the Australian Consumer Law that cannot be excluded, restricted, or modified by contract.
All jurisdictions: Where any provision of these Terms conflicts with a mandatory consumer protection law applicable in your jurisdiction, that provision is severed or read down to the extent necessary.
21. Governing Law & Jurisdiction
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.
Subject to mandatory consumer protection laws in your jurisdiction — which may require disputes to be resolved locally or entitle you to bring proceedings in your home jurisdiction — disputes arising under these Terms shall be subject to the jurisdiction of the courts of Hong Kong SAR.
22. Dispute Resolution
22.1 Direct resolution
If you have a complaint, please contact us first at tesshin.bjj@gmail.com. Tesshin will make reasonable efforts to resolve disputes promptly and fairly.
22.2 EU — Online Dispute Resolution
EU consumers may access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Tesshin is not obliged to participate in ADR proceedings but is required to provide this information.
22.3 UK consumers
UK consumers may seek resolution through a certified ADR scheme or through the courts.
23. General Provisions
Severability: If any provision of these Terms is held invalid or unenforceable, it is severed and the remaining provisions continue in full force.
Waiver: Tesshin's failure to enforce any provision of these Terms does not constitute a waiver of that or any other right.
Entire agreement: These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Tesshin regarding the Services. This does not affect rights you have under mandatory law that cannot be modified by contract.
Assignment: You may not assign your rights or obligations under these Terms without Tesshin's prior written consent. Tesshin may assign these Terms without notice.
24. Changes to These Terms
Tesshin may update these Terms at any time by publishing a revised version on our website. Continued use of the Services after publication constitutes acceptance of the revised Terms. Orders placed before a change is published are governed by the Terms in effect at the time the contract was formed.
